We have recently concluded a personal injury claim for a 38 year old man whose hand became trapped in a conveyor belt when loading parcels at work.  His employers tried to argue that he was partially to blame for the accident but we managed to obtain judgment at an interim hearing to defeat this argument.

As well as suffering a crush injury to his hand our client suffered from post traumatic stress disorder as a result of the accident.  His employment was terminated following the accident and although he tried to find alternative employment, it was a number of years before he found a permanent alternative job.

The Defendant made a low settlement offer early on and refused to increase this arguing that the medical evidence suggested that the hand injury was not that bad and that our client should have been able to return to full time employment long before he did.   It therefore looked as though the case would need to go to trial to be resolved, but on the eve of a settlement court hearing which the employer’s representatives were obliged to attend, their position suddenly changed and they made a number of attempts to reach settlement, increasing their offer by over 100% in a matter of hours.  Settlement was finally agreed in line with our valuation of £85,000.00.
