The Claimant was a 57 year old woman.  She was riding her bicycle when she was knocked off by a car landing on her shoulder.

Following the accident she was taken to the A & E department of Wexham Park hospital where she received an x-ray which showed a fracture of her left clavicle.

The Claimant decided against having an operation to repair her clavicle and instead wore a sling. The pain in her shoulder improved after 3 months.

As a result of the accident the Claimant was unable to drive for 1 month and lost out on earning overtime pay at work.

The third party insurers admitted liability and put forward a Part 36 Offer of £4,500.00 which was rejected.

We then put forward a counter-offer in the sum of £7,500.00 which was rejected by the third party.  In response they made an offer of £5,500.00. We rejected this offer and put forward a further offer of £6,500.00. 

This offer was initially rejected by the third party insurers, however after some negotiation they agreed to our offer of £6,500.00. 

The Claimant was very happy with her settlement.
