Client Seeking Compensation From MIB Due To RTA With Uninsured Driver
Our client was involved in a road traffic accident with an uninsured driver, sustaining personal injury and financial losses. A claim was duly submitted to the Motor Insurers Bureau (MIB) who were appointed to act on behalf of the uninsured driver. Unfortunately, the MIB did not undertake timely investigations into the matter and by the time they did investigate the accident circumstances, the uninsured driver could not be traced. The MIB initially indicated that they would have to deal with our client's claim under their Untraced Drivers Agreement which would have meant that their costs in pursuing the claim would not have been met by the MIB and could have resulted in a reduction in their damages and certain elements of his claim not being eligible for recompense. Fortunately, following discussions with the MIB, they accepted that if they had acted more promptly, they would have been able to locate the uninsured driver (particularly as he was prosecuted following the accident for driving without insurance) and they have dealt with our client's claim under the Uninsured Drivers Agreement, meaning that he is able to claim his legal costs and all elements of his claim have been considered.
