Compensation Awarded Due to Faulty Shelf Fixtures

The client was 35 years at the date of the accident.  He was employed as a factory worker to make fruit machines.  His employers had recently relocated and taken the shelves/racking down from the old factory and re-installed them in the new premises.   The client advised that when the shelves were re-installed it became apparent some of the locking pins were missing.  The employers were advised of this but did not replace them before the date of the accident.

On the date of the accident the client was reaching into the bottom shelf for some components when the middle shelf collapsed and fell onto his back.  His colleagues had to lift the shelf off him.

The client sustained soft tissue injury to his back.

Liability was initially admitted by the insurers but later withdrawn on the instruction of the employers.  A site inspection was arranged and instructing solicitors attended with the client and an independent engineer, instructed by the employers.  Following the site inspection the engineers report was not disclosed but the employers then admitted full liability.

The client’s claim was settled for £5,500.00 comprising £4,000.00 for general damages and £1,500.00 for past financial losses.
