Our client submitted a personal injury claim as a result of an injury sustained whilst walking along a footpath at about 8.30pm. The land in question was owned by The National Trust. It was dark and there was no lighting around the footpath. As a result, the client fell over a low level chain fence, secured by two fence posts across the footpath. As the client was using a public right of way he was owed a common duty of care by the Defendant. As a result of his fall the client sustained a fracture to his left wrist. The client is a self employed builder who is left handed.

The Defendants disputed liability in full from the start of the claim. One month before Trial they accepted liability and our client received £9,000.00 in compensation for his injuries and financial losses.
