The Claimant, aged 55 at the time of the accident, submitted a personal injury claim as a result of an injury sustained whilst visiting a McDonalds restaurant. The Claimant had sat down on a wall mounted seat when the seat collapsed and he fell to the floor causing injuries to his right wrist.

It was alleged that the Defendants had failed to check their chairs for any defects and if found to be defective, repair them. There were no warning signs to show there was anything wrong with the chair.

The Defendant’s insurers admitted liability for the client’s accident.
 
The Claimant suffered a soft tissue injury to his right wrist. Ordinarily the Claimant would have recovered from these symptoms within 3 months of the accident, however the client had pre-existing degenerative symptoms. Any symptoms beyond 3 months are as a result of the pre-existing symptoms, not the accident.

The Claimant received £2,000.00 in compensation.
