Compensation For Employee of Landscaping Company
Our client worked for a landscaping company. In the dead winter he was planting a substantial tree with a co-worker whilst another had been called away to a different part of the site. They had no mechanical assistance. The ground was frozen hard. As they moved the tree root into the hole prepared for it the root ball rolled and trapped our client's ankle underneath it. The ankle was fractured. He attended hospital and was off work. Liability was denied and our client alleged to have been the 'author of his own misfortune'. However, an offer to settle was a received after issue of proceedings and our client received £4000.00 damages for injuries and lost earnings.
