Compensation for injured motorcyclist
This case involved a 32 year old man who was knocked off his motorcycle. Whilst there was no dispute over liability for his most obvious injury – a fractured left metatarsal, there was a dispute as to whether the injuries he sustained in that accident included a fractured scaphoid, which was not diagnosed until a year or so later. The significance of this is that this particular injury has implications for him continuing his work as a mechanic. This issue of causation was heard before the court who found in favour of the claimant. The case is partly concluded and we are now concentrating on quantifying the case.
