The Claimant was a 41 year woman involved in a road traffic accident in November 2008. The defendant’s van failed to stop behind the Claimant’s car and a collision occurred between the two vehicles. The claim was carried out under a ‘No Win, No Fee’ agreement and liability for the accident was admitted by the defendant’s insurer. The Claimant suffered a soft tissue injury to her back from which she made a recovery within one month. She also suffered a two week injury to her neck. The Claimant suffered no significant side effects as a result of the personal injury and was able to continue with her lifestyle as normal.

The Claimant received a total settlement in the sum of £1752.00 from the Defendant’s insurer, £1000.00 of which was in respect of the injuries suffered as a result of the accident. The Defendant’s insurer had initially made an offer of £800.00 in respect of general damages. The Claimant also received damages for her losses and expenses resulting from the personal injury claim in the sum of £752.00, which included a claim for 21 days without the use of a vehicle and her policy excess.
