Employer's Liability Claim
Our client submitted a personal injury claim as a result of an accident in August 2008. Our client was acting in the course of his employment duties picking wood off a conveyor belt . A large piece of wood caught on his finger pushing it onto a metal bar causing injuries. The re was no emergency stop button in situ to prevent this accident from occurring.
Our client suffered a crushed little finger.
A claim was brought against the Defendants in accordance with The Management of Health and Safety at Work Regulations 1999, the Provision and Use of Work Equipment Regulations 1998 and the Workplace (Health, Safety and Welfare) Regulations 1992. The Defendant’s were negligent in that not only failed to make a suitable and sufficient assessment of the risks to the health and safety to which the Claimant was exposed whilst he was at work and they exposed the Claimant to a foreseeable risk of injury.
Liability was admitted in full.
The Claimant has attended an appointment with a medical expert and is now awaiting an assessment with a Plastic Surgeon to report on his ongoing symptoms.
