How to Fund Your Compensation Claim
Legal Expenses Insurance:
You may have legal expenses cover that you may not even be aware of under existing insurance policies, such as car and household insurance policies. If you do have such cover the insurance company will pay your legal costs.
Trade Union:
If you are a member of a Trade Union you may have legal expenses cover through your membership which will cover the costs of bringing a claim.
Legal aid for clinical negligence claims:
If you have a low income you may be eligible for legal aid. If you are in receipt of income support, income based job seekers allowance, or state pension credit you are automatically eligible.
However, if you have a disposable income of less that £698 per month and have capital of less than £8,000 you may also be eligible, but may need to make a financial contribution.
Children are automatically eligible for legal aid.
“No Win, No Fee”:
If no other funding option is available your solicitor can pursue the case under a Conditional Fee agreement, commonly known as a “No Win No Fee” agreement. If you are successful your solicitors will obtain their fees from the losing party and NOT from your compensation. We will also receive a success fee, which is a percentage uplift on our basic costs and again is paid directly by the Defendant's insurers. This will be paid in addition to any compensation, so you will receive 100% of anything awarded to you.
If the claim is unsuccessful we will waive our fees, so will not be paid. So win or lose it will not cost anything to make the claim.
The only time you would be liable for our costs are in the following situations:
1) If the claim is fraudulent - if you have mislead us in any way
2) If you cease to instruct us part way through the claim
3) If you instruct us to act against our advice - this would arise in situations where you ask us to proceed in a way detrimental to the case and we advise against it.
Your solicitor will also ensure that you have insurance in place to pay for the other party’s costs in case you lose. You may already have this insurance under an existing policy, as explained above. Failing this, After the Event insurance will be taken out, which you will not be asked to pay for.
