Liability Admitted For Collision At Roundabout

We acted for a client who was involved in a road traffic accident on a roundabout.  Our client was in the right hand lane of a dual carriageway going straight on (2nd exit).  The other driver was in the left hand and attempted to take the 3rd exit.  The other driver's insurers disputed liability on the basis that our client was in the wrong lane - they argued that the 3rd lane was the straight on exit and the 2nd exit was a left turn.  They forwarded a copy of the driver's diagram in support of their argument.  A quick search of google maps and it was easy to establish that the lanes were clearly marked and the 2nd exit was the straight on exit.  We immediately reverted to the insurers with a copy of the map pointing out that there insured was clearly in the wrong lane.  Initially the insurers proposed a split liability settlement of 75/25 in our client's favour on the basis that our client should have taken evasive action.  This was quickly rejected and the insurers finally conceded liability for the accident.  We secured a payment for our client's personal injury claim and for the damage to his vehicle.
