Loitering Or Crossing The Road Safely?
The client was a pedestrian who was out with her friends. She had left the restaurant and was walking towards the zebra crossing ready to cross the road when a car came around the roundabout and hit her. She suffered from injury to both her knees and legs. The third party insurers refused to admit liability on the basis that the client had deliberately leaped over the railing near the crossing and because of a frolic of her own, got injured as a result. The client has had knee operations and MRI scan. CCTV was used to validate the clients’ actions and she settled her claim. Her injury was to be of a permanent nature.
