Occupational Asthma
Southampton-based law firm warns of occupational asthma
As the British Lung Foundation encourages people to ‘love their lungs’ during its ‘Breathe Easy Week’ campaign, Southampton-based personal injury law specialists Moore Blatch Resolve warns of the dangers of occupational asthma as reports estimate that between 1500 and 3000 people a year develop the condition. Occupational asthma is an allergic reaction that can occur following exposure to a particular substance, for example flour or grain and types of paints and solvents. Once lungs become hypersensitive to a substance, further exposure, even at low levels, may trigger an attack. The Health and Safety Executive (HSE) estimates that between 1500 and 3000 people a year will develop occupational asthma, with that figure rising to 7000 cases a year if you include asthma made worse by work. People most at risk are those employed as vehicle spray painters, bakers, woodworkers, healthcare workers, laboratory animal workers, agricultural workers and engineers. Damian Horan, head of legal practice at Moore Blatch Resolve, comments: “It is well recognised that certain substances can be harmful to employees and can cause conditions such as asthma. The Control of Substances Hazardous to Health Regulation 2002 (COSHH) dictates that employers must control potentially harmful substances in the workplace by, for example: eliminating / minimising risk of exposure; providing appropriate protective equipment; and conducting regular health surveillance, including regular lung functions tests. Unfortunately, there are still workers who are being put at risk by employers who are in breach of health and safety laws. “It is important that people are aware of these health and safety regulations to ensure that as an employee you are being suitably protected and as an employer you are taking the correct steps to protect your workers.” Moore Blatch Resolve has a team of specialist solicitors with extensive experience of dealing with occupational asthma claims. Damian continues: “We deal with many cases where people have either developed occupational asthma or have seen their existing condition worsen, and have secured substantial compensation for them. Symptoms of the condition can vary, and it is important to be aware that the symptoms of asthma can present themselves up to 25 years after exposure.”
