Occupiers Liability Claim
Our client submitted a personal injury claim as a result of an accident in May 2008.
Our client, whilst visiting her mother who was a resident at a residential home, sat down onto a plastic moulded chair in the gardens. As she sat down, one of the front legs collapsed and the Claimant fell heavily to the floor, causing injuries. It transpired that the plastic chairs are left in the gardens of the home throughout the year.
Liability was admitted in full on the basis the Defendant’s failed to maintain their property and exposed the client to a foreseeable risk of injury.
The client suffered a soft tissue injury to her little finger which resolved within 4 weeks. She was offered £750.00 in compensation. This was disputed and settled for £1,100.00.
The Claimant’s costs were agreed at £6,100.00.
