Road Traffic Accident Caused By Unlit Trailer On Motorway
The claimant was driving his vehicle on the M4 eastbound in the early morning. It was late January and so it was very dark at that time. He was proceeding correctly when he noticed a stationary trailer on the motorway. The trailer was unlit. The Claimant had to swerve in order to avoid colliding with the trailer. In doing so, he collided with another vehicle, which had already collided with the unlit trailer.
Liability for the accident was under investigation for a period of time and so we applied for a police report. The police report confirmed that the third party was liable and the third party insurers eventually admitted fault for the accident.
The client sustained a number of injuries including a 2 week injury to his neck, an 8 week injury to his chest and abrasions to his nose and right arm.
The client also suffered some minor superficial scarring to his right arm. The medical report confirmed that the scarring did not cause the client too much emotional upset but that it was noticeable. The client sent in photographs and we disclosed these to the third party insurers.
The client sustained some financial losses, i.e. loss of earnings and insurance excess. These were all agreed in full.
We managed to secure the client £2750.00 for his physical injuries, including the minor scarring. The entire claim settled for £3111.25.
