Road Traffic Accident Claim
Peter was involved in a road traffic accident. He was riding his motorcycle on a dual carriageway near his home in Stafford when the Defendant, who was driving a pick-up truck drove out of a side road and knocked him off his bike.
The Claimant suffered serious damage to his left foot and this involved loss of bone and lacerations to his calf. After the initial stabilisation he was taken to a specialist unit to have the wound debrided and a skin graft to his left foot.
At the time of the accident, he was a 36 year old man with a large family, living in a 3 bedroom house. Prior to the accident he had intended to substantially renovate this with his father, a recently retired builder. He was employed by a major construction company as a product development manager. His job involved being on the shop floor a lot and he had to wear protective boots.
He was unable to return to work after the accident and his recovery thereafter has been slow. The site of his surgery took 18 months to 2 years to stop discharging and he was on antibiotics for over a year.
He has not been able to return to work because he has been unable to wear the necessary equipment, protective footwear, due to his injuries.
Currently, Peter is having rehabilitation which is being provided and paid for by the Defendant. The initial assessment has concluded that he needs the following:-
- Pain management intervention
- Physiotherapy
- Psychological input
- Occupational therapy in order for him to return to work. This may include re-training or special footwear being created
- Adaptations to his home
- Gardening assistance
As the client has always worked in the construction industry it is going to be difficult for him to return to work without substantial re-training due to the nature of his injuries.
In addition, he is also making a claim for the cost of renovating his house. The money that he had saved to do that had to be used for daily living as he was unable to work and neither he nor his father are able to take on such heavy work now.
We have put together a Schedule of Losses in order that the claim can be valued more accurately.
