RTA Case Study Involving Exacerbation of Fibromyalgia

Back to Case Studies

The claimant was stationary waiting to proceed onto a roundabout when the third party collided with the rear of the claimant’s vehicle.

The Claimant’s vehicle was not a write off and we managed to recover the repair charges, which totalled £1700.00.

The Claimant sustained whiplash injuries to her neck and back. The Claimant also suffered an exacerbation of a pre-existing condition (Fibromyalgia). The expert confirmed that these symptoms were aggravated by a period of 6-8 weeks from the date of the accident. The expert confirmed that overall the Claimant would suffer mild discomfort for a period of 18 months.

Due to the fact that the Claimant suffered an aggravation of a pre-existing condition we thought it best to simply invite offers to begin with.

The third party insurers came back to us with an offer of £3000.00 in full and final settlement.

We then made a Part 36 Formal offer to settle the Claimant’s claim for £3800.00 in full and final. Our offer was accepted.
