Substantial Damages Following Hit and Run Accident.
We recently concluded the settlement of a claim for a young man who was involved in an accident on the motorway.
Our client was working from the back of a flat bed lorry picking up cones from the motorway. Whilst he was in the process of doing this a large van swerved towards him. The evidence suggested that the wing mirror of the van caught our client on his head and as a result he suffered a fracture to his skull and damage to the frontal lobes of his brain.
We were able to piece together sufficient evidence to persuade the MIB that our client’s injuries had been caused by the negligence of an unidentified and untraced driver and as such our client was entitled to be compensated under the terms of the Untraced Drivers’ Agreement. This is a scheme which the Motor Insurers Bureau runs for the benefit of victims of hit and run accidents.
Our client was assessed by a number of experts including a Neurologist, Neuropsychologist and Psychiatrist. Following negotiations with the MIB we recovered damages including a contribution towards his costs in excess of £200,000.00.
Our client’s damages are being invested into a Special Needs Trust in order to protect the State Benefits that our client now receives which he requires in order to meet his day to day expenses.
