Trip in the Darkness

Back to Case Studies

The Claimant and her family visited a restaurant in the early evening for a meal.  At the end of the meal the Claimant asked to see the manager who, incidentally,  was a long standing friend.  To do so she had to leave the premises via the rear entrance and climb a set of external steps to the flat above.

It was dark at the rear of the premises, with no lighting, and the Claimant tripped down a concrete plinth sustaining a soft tissue injury to her foot and ankle.

We had difficulty in obtaining an initial response from the bistro chain, but liability was established soon after.

Medical evidence was then obtained and settlement was reached in the sum of £3,500. The Claimant was delighted with the outcome.
