Update on the pleural plaques decision

In October 2007, a landmark judgement by the House of Lords ruled that sufferers of pleural plaques were not eligible to make a claim against their employers. Since then, campaigners have been pressing for a reversal of the decision.

The Damages (Asbestos-Related Conditions) Bill passed through the House of Commons on 16 October 2009. The Bill is designed to overturn the 2007 ruling and return the law to its previous position. The Bill will now go to the House of Lords to consider.

Pleural plaques are scarring on the lungs cause by an exposure to asbestos. The plaques themselves do not cause or develop into more serious asbestos-related conditions and the plaques do not cause any adverse symptoms. The House of Lords decided in 2007 that as the plaques were symptomless and did not increase the risk or likelihood of any other asbestos-related disease, there could be no claim for personal injury.
