Warehouse Accidents
Back to Accident at Work Claims
Many accidents occur in the warehouse during the course of an individual’s employment. An employer is responsible for the maintenance and safety of the warehouse itself and consequently the health and safety of the employees whilst they are in the workplace. Sometimes warehouse accommodation is rented by the employer and in these circumstances either the employer or the owner (or both) can be liable. This is established by a negligible act or omission by the owner or under his duty as occupier toward his tenants. The employer’s responsibility is formed by statutory workplace regulations or negligence on their behalf.
Warehouse accidents happen most commonly because of spillages, faulty machinery or obstructed walkways. Other common warehouse accidents involve forklift trucks and ladders. Risk assessment forms and health and safety checks should be carried out by the employer at regular intervals. More often than not the employer will be liable for the danger and the accident caused if these precautionary measures are not undertaken.
Recently it has been established that risk assessments must be carried out specifically in respect of pregnant employees. Employers have to take into account individual characteristics that might need special safety treatment, for example disabled or impaired employees.
Even if another employee is responsible for an injury caused to you this can still give rise to a claim for personal injury. If the proper training has not been given an employer is solely responsible for the mistakes of his employees.
