Witnesses Worth It In Liability Dispute
Our client, Mr T, was injured when moving past a van he had been following.
The van driver, Mr D, had indicated and begun to move over to the side of the road where there were parking spaces in front of some shops. Mr T therefore moved to the right hand side of the road and looked to overtake Mr D.
Mr D decided that he no longer wished to park on the left and pulled straight back out to the centre of the road without checking for any traffic behind him coming by. He collided with our client, Mr T.
Mr D, through his insurers, was denying liability for this matter and was looking to settle on a split liability basis at best. However, Mr T had been able to take the details of a driver a few cars behind him when the accident happened, Mr W.
Upon contacting Mr W we were able to obtain a witness statement in support of Mr T’s claim which was then forwarded to Mr D’s insurers. Upon receipt of this, along with further discussions, we were able to get liability admitted in favour of Mr T in full.
After getting Mr T medically examined and disclosing their report we were able to obtain an award of £1900.00 for his 9 month soft tissue whiplash type injury. He did not have any further losses to recover in this matter and therefore the award was solely for his injuries and did fall into our bracket for what was a reasonable settlement in this matter.
Needless to say, Mr T went away from this satisfied with the result.
