- How will my claim process work?

Your claim will only be handled by one of our experienced personal injury compensation lawyers who will guide you through the legal and medical issues and keep you fully informed every step of the way, at absolutely no cost to you. The claims process will depend on the complexity of your case, but typically your solicitor will:- Prepare the case for you against the person, company or other party at fault.
- Arrange the best funding for your case, such as a 'no win, no fee’ agreement.
- Arrange for a consultant to prepare a medical report about your injury or illness, in order to assess and support your claim to compensate for pain, suffering and loss of amenity.
- Obtain the advice of our retained experts in rehabilitation, accountancy and medicine to ensure all elements of your claim are fully explored.

- Do I have a claim?

Don't delay - most claims for compensation must be made within three years of the date of a personal accident or injury, although there may be some exceptions, such as industrial disease. - How long will it take to settle my claim?
This depends on how complicated your case is. Most cases are settled within a matter of months. A few, very complicated cases, involving complex issues that might take quite a bit longer to resolve, can take a year or more. A 'no win, no fee' agreement means that if you proceeded with a claim but lost the case you would not have to pay your own or your opponent's legal costs. Personal injury compensation claims will normally be split into two parts.
General Damages: : to compensate for the pain and suffering of your injury, both the initial injury and any ongoing suffering or disability; loss of amenity or enjoyment of life; and for any disadvantage in the labour market caused by permanent injury. Claims for compensation must be made within certain time limits and these depend on what caused the injury. Most cases must be brought within three years from the date of the accident or injury but certain exceptions apply:
- When a child has been injured, the three years start to run from their 18th birthday.
- In industrial disease cases, the normal three-year time limit will only start to run from when you first became aware of the problem - called 'the date of knowledge’.
- Criminal injury matters have a time limit of two years.
- Claims involving accidents abroad may have different limitation periods.
- What does 'no win no fee' mean?
The 'no win, no fee' claim scheme, also known as the 'conditional fee' scheme, came fully into effect in 1998 when Legal Aid was withdrawn for most personal injury claims. As Legal Aid is funded by central government, the decision was made to reduce the burden on the public purse and pass the financial risk of accident claims to the legal profession.
A 'no win, no fee' agreement means that if you proceed with a claim but lose the case, you will not have to pay your own or your opponent's legal costs. The solicitor acting in the claim is only entitled to be paid a fee if the case is successful, and the losers or their insurance company usually makes that payment. If the case is lost, then the solicitor will lose their legal fees.

- Will I have to go to court?
No insurer wants to waste time and money in court defending a hopeless case. The facts about who was at fault in any given case are usually fairly clear and more than 90% of cases are settled without going to court. The costs involved in litigation are incredibly high and in cases of overwhelming evidence, it is highly unlikely that the opponent's defendant will risk a court hearing and consequential costs.
- Are my personal details secure?

- Does the accident have to have happened in England?

- Will I need to visit a private doctor?
Most personal injury claims require a medical report to officially detail your injuries and how they have specifically affected you. This report is used to calculate your general damages claim to compensate for pain, suffering and loss of amenity. MyClaim will organise the medical report for you through our established network of consultants, who are specialists in your type of injury and experienced in making such reports. You will not need to pay - MyClaim will arrange the funding for your medical report.
- Do I need to meet my solicitor?
This is up to you - most people are happy to keep in touch by telephone, email and letters but some people prefer to meet their solicitor face to face. If required, your MyClaim solicitor will visit you in hospital or at home.
